    HOME MATCH TICKET CONDITIONS OF ISSUE


    1. Issue of Home Match Ticket

    1.1 The issue of a Home Match Ticket and subsequent access to the Ground is subject to the Terms & Conditions of Entry (which can be found on or accessed via the Club's website at www.cpfc.co.uk or can be provided upon written request to the Club).

    1.2 Home Match Tickets are for the use of supporters of the Club only. By applying for the Home Match Ticket and/or using the same you hereby warrant and represent that you are a supporter of the Club and/or that you are not a supporter of the Visiting Club.


    2. Admission to the Ground

    2.1 By purchasing and/or accepting and/or holding a Home Match Ticket and/or using a Home Match Ticket to gain access to the Ground, you: (a) certify that you have read, understood and accepted; (b) agree to be bound by and to comply with; and (c) agree to bring to the attention of others, as required below, the Terms & Conditions of Entry.

    2.2 A Home Match Ticket permits you to occupy at the Match the seat indicated on the Home Match Ticket or such other alternative seat of equivalent value as the Club may allocate to you at its reasonable discretion. All access to the Ground pursuant to a Home Match Ticket shall be for the purposes of private enjoyment of the Match only, not for any commercial purpose (and no authorisation is given or implied in respect of the carrying out of any commercial activities).

    2.3 Nothing in these Conditions of Issue shall constitute or imply any entitlement to occupy the seat indicated on the Home Match Ticket in any subsequent Match or season.

    2.4 Save as set out in clause 2.5 below, you shall not capture, log, record, transmit, play, issue, show or otherwise communicate (by digital or other means) any Material in relation to the Match, any players or other persons present in the Ground and/or the Ground, nor may you bring into the Ground or use within the Ground (or provide to, facilitate or otherwise assist another person to use within the Ground) any equipment or technology which is capable of capturing, logging, recording, transmitting, playing, issuing, showing or otherwise communicating (by digital or other means) any such Material. Any person acting in breach of this provision may have such equipment or technology confiscated and/or will be required to deliver up any tapes, films, disks, memory cards, memory sticks or other recordings of the Material (and all copies thereof) in whatever form, to the Premier League and/or the Club and the copyright, database right and all other rights, title and interest in and to all Material is hereby assigned to the Premier League, including by way of present assignment of future copyright pursuant to section 91 of the Copyright, Designs and Patents Act 1988. You further agree (if and whenever required to do so by the Premier League) to promptly execute all instruments and do all things necessary to vest the right, title and interest in such rights to the Premier League absolutely and with full title guarantee.

    2.5 Mobile telephones and other mobile devices are permitted within the Ground PROVIDED THAT (a) they are used for personal and private use only (which, for the avoidance of doubt and by way of example only, shall not include the capturing, logging, recording, transmitting, playing, issuing, showing, or any other communication of any Material for any commercial purposes); and (b) no Material that is captured by a mobile telephone or other mobile device may be published or otherwise made available to any third parties including, without limitation, via social networking sites.

    2.6 Save for official Club merchandise and/or other football related clothing worn in good faith, you shall not bring into, use, wear, or display within the Ground any sponsorship, promotional or marketing materials. No clothing should be worn that could in any way be seen to promote racial or any form of discrimination which could lead to offence.

    2.7 You shall not offer or distribute (either free or for sale by any person) within the Ground any consumer article or commercial product of any nature. For the avoidance of doubt this clause shall not prevent the lawful distribution of text publications in any format which do not infringe clause 2.5 above where both the content and the publication are lawful in all respects and do not in the Club's reasonable opinion constitute a threat to public order.

    2.8 The Club reserves the right to refuse admission to, or eject from, the Ground any person who fails to comply with the Terms & Conditions of Entry.

    2.9 Without prejudice to the representation at clause 1.2, above, and in light of the Home Match Ticket holders being grouped together in designated areas, any attempt to gain access to the Ground wearing or carrying apparel (including, without limitation, hats and/or scarves) that demonstrate support for the Visiting Club, may result in admission being refused or you being ejected from the Ground and in such circumstances no refund or alternative seat will be offered.

    2.10 For the safety of infants and all supporters, Home Match Tickets are not available for infants under the age of 2 or babes in arms at any time during the Season and no infant under the age of 2 or babes in arms is allowed entry to the Ground to attend a Match.

    2.11 Children under the age of 12 years MUST be accompanied by someone aged 18 or over.


    3.Use of Home Match Ticket

    3.1 Subject to clause 3.3, below, the Home Match Ticket is issued for your sole use and you shall not sell, dispose of, assign, transfer or otherwise deal with the Home Match Ticket or the benefit of it to any other person without the prior written consent of the Club. Further you shall not use the Home Match Ticket for any commercial purpose. The reference to selling the Home Match Ticket includes: (a) offering to sell a Home Match Ticket (including, without limitation, via any website or online auction site); (b) exposing a Home Match Ticket for sale; (c) making a Home Match Ticket available for sale by another person; (d) advertising that a Home Match Ticket is available for purchase, which for the avoidance of doubt (and by way of example only) means that this Home Match Ticket may not be offered as a prize in any promotion or competition; (e) transferring, lending or selling a Home Match Ticket to any third party as part of a hospitality or travel package; and (f) giving (or offering to give) a Home Match Ticket to a person who pays or agrees to pay for some other goods or services (or offers to do so); all save as expressly authorised by the Premier League or the Club.

    3.2 The unauthorised sale or disposal of a Home Match Ticket may amount to a criminal offence under section 166 of the Criminal Justice and Public Order Act 1994, as amended by the Violent Crime Reduction Act 2006. The Club will inform the police when it becomes aware that a Home Match Ticket has been sold, or disposed of illegally and will press for charges to be brought against those breaking this law. If you are convicted of a ticket touting offence, or we reasonably suspect you have committed such an offence, we will notify the Premier League who may in turn notify other football clubs, event holders and/or the relevant law enforcement authorities. The information that we share may include your personal data, information about the offence and about ticket purchases (including payment details). We will use this to identify and prevent ticket touting offences and disorder at matches.

    3.3 If more than one Home Match Ticket is issued to you, one Home Match Ticket must be retained by you, for personal use (subject to the provisions below) and the remainder may be transferred to your Guest(s) for his/her/their personal use only PROVIDED THAT such transfer takes place in consideration of no payment or benefit in excess of the face value of the Home Match Ticket, and such transfer does not take place in the course of any business or for the purpose of facilitating any third party's business. Such transfer to any Guest will be subject to the Terms & Conditions of Entry which will (save for any rights to transfer under this clause) apply to and bind each Guest as if he/she was the original purchaser of the Home Match Ticket (and you must inform the Guest(s) of this). You will provide the name and address of your Guest(s) when asked to do so by any official, steward or employee of the Club and/or any police officer. In the event that you and/or your Guest(s) are unable to use any Home Match Ticket then you may transfer that Home Match Ticket(s) to a natural person who is known to you personally and who would be entitled (under the Terms & Conditions of Entry and otherwise) to purchase such Home Match Ticket and attend such Match PROVIDED THAT such transfer takes place in consideration of no payment or benefit in excess of the face value of the Home Match Ticket, and such transfer does not take place in the course of any business or for the purpose of facilitating any third party's business. Such transfer will be subject to the Terms & Conditions of Entry which will (save for any rights to transfer under this clause) apply to and bind the transferee as if he was the original purchaser of the Home Match Ticket (and you must inform the transferee of this). You will provide the name and address of the transferee when asked to do so by any official, steward or employee of the Club and/or any police officer.

    3.4 The Home Match Ticket will remain the property of the Club at all times and must be produced together with evidence of your identity if required to do so by any official, steward or employee of the Club or any police officer. The Club reserves the right to require the immediate return of the Home Match Ticket at any time.

    3.5 Any Home Match Ticket obtained or used in breach of the Terms & Conditions of Entry shall be automatically void and all rights conferred or evidenced by such Home Match Ticket shall be nullified. Any person seeking to use a Home Match Ticket in breach of the Terms and Conditions of Entry in order to gain entry to the Ground or remain at a Match will be considered to be a trespasser and will be refused entry to, or ejected from, the Ground in respect of a particular Match and/or may have his/her Home Match Ticket cancelled or withdrawn. In the event of any cancellation and withdrawal in accordance with this clause 3.5, no refund shall be payable. The Club further reserves its right to take any legal or disciplinary action against any person(s) as it sees fit in connection with such matters, including a claim for an account of any profits made from an unauthorised use of a Home Match Ticket.


    4. Changes to Dates, Postponements and Abandonments

    4.1 No guarantees can be given by the Club that the Match will take place at a particular time or on a particular date. Subject to clauses 4.2 to 4.3, below, the Club reserves the right to reschedule any Match without notice and without any liability whatsoever.

    4.2 In the event of the postponement or abandonment of the Match prior to kick off (or if the Match has, for any reason, to be played out of view of the public), you will be entitled to receive the equivalent ticket for the subsequent re-arranged Match via such application procedure as the Club stipulates.

    4.3 In the event of the abandonment of the Match after kick off you will be entitled to receive half price admission in the event that the Match is rearranged via such application procedure as the Club stipulates.

    4.4 The Club will have no further liability whatsoever in relation to clauses 4.2 to 4.3, including (but not limited to) any indirect or consequential loss or damage, loss of enjoyment or travel/accommodation costs.


    5.Lost or Stolen Home Match Tickets

    5.1 In order to gain admission to the Ground, the Home Match Ticket must be presented in its entirety at the Match.

    5.2 The Club shall not be obliged to issue any replacement for a lost, stolen or destroyed Home Match Ticket.


    6. Cancellation & Withdrawal of Home Match Ticket

    6.1 Without prejudice to any other remedies it may have, the Club shall have the right in the case of any serious or persistent breach of the Terms & Conditions of Entry to cancel and withdraw any Home Match Ticket issued to you. In the event of such cancellation no refund will be paid. Without prejudice to the general nature of the above, the following actions shall constitute serious breach of the Terms & Conditions of Entry:

    6.1.1 smoking in designated non-smoking areas;

    6.1.2 being (or appearing to be) drunk or intoxicated;

    6.1.3 persistent standing in seated areas whilst the Match is in progress;

    6.1.4 the sale or transfer (save as permitted) of a Home Match Ticket to any person;

    6.1.5 the deliberate misuse of a Home Match Ticket;

    6.1.6 any misrepresentation in relation to clause 1.2 above;

    6.1.7 the possession of a banner or flag or wearing of clothing that bears material or slogans that are foul, offensive, obscene, abusive or racist;

    6.1.8 the throwing of any object within the Ground that may cause injury, damage, distress or annoyance to people or property without lawful authority or excuse;

    6.1.9 whether at the Ground, or, travelling to a Match:

    6.1.9.1 the use of foul, offensive, obscene, abusive and/or racist language and/or gestures;

    6.1.9.2 the chanting of anything of an indecent or racist nature ;

    6.1.9.3 fighting, or engaging in and/or inciting violence;

    6.1.10 bringing any of the following into the Ground (or using them within the Ground): illegal drugs; other illegal substances; fireworks; firecrackers; smoke canisters; air horns; flares; laser devices; bottles; glass vessels or any item that might be used as a weapon or compromise public safety;

    6.1.11 entering the playing area or any adjacent area to which spectators are not generally admitted without lawful authority or excuse;

    6.1.12 the supply of any misleading or incorrect information in any application;

    6.1.13 any breach of clauses 2.4, 2.5 or 2.6 above; and

    6.1.14 any failure to pay or default of payment in respect of any sums owing to the Club (or any third party) in respect of any Home Match Ticket.

    6.2 The Club may conduct security searches where it has reason to believe that any of the breaches set down in 6.1 has either occurred or may occur.

    6.3 If a Home Match Ticket holder is not 16 years old or over, his/her parent(s) and/or guardian(s) are responsible for his/her actions, conduct and compliance with the Terms and Conditions of Entry.

    6.4 In the event that your Home Match Ticket is withdrawn or cancelled the Club reserves the right to exclude you from any membership scheme maintained or organised by the Club and/or to disqualify you from applying for any Match ticket or season ticket at its discretion and to notify any Football Authority and/or other football clubs of such exclusion and/or disqualification (and the reason(s) for such exclusion and/or disqualification).


    7. Filming, photography and taping

    7.1 All Home Match Ticket holders who enter the Ground acknowledge that photographic images and/or audio, visual and/or audio-visual recordings and/or feeds (and/or stills taken therefrom) may be taken of them and may also be used, by way of example and without limitation, in televised coverage of the game and/or for promotional, training, editorial or marketing purposes by the Club, the Premier League or others (including commercial partners and accredited media organisations), and use of a Home Match Ticket to enter the Ground constitutes consent to such use.


    8. Exclusion of Liability

    8.1 The Club hereby excludes any liability for loss, injury or damage to persons/property in or around the Ground except in respect of death or personal injury resulting from any negligence of the Club or any other liability of the Club which cannot be excluded under applicable law.

    8.2 Neither the Premier League nor the Club shall be responsible for any interruptions and/or restrictions to the view of the Match caused by virtue of (i) the position of the seat and/or (ii) the actions of other spectators.


    9. General

    9.1 The Club reserves the right to change these Conditions of Issue from time to time, and shall notify you of such changes if they materially affect your rights as a consumer.

    9.2 You consent to the Club holding and processing data relating to you for administrative and legal purposes. The personal data that you provide to the Club shall be processed, stored and transferred in accordance with the terms of the Club's privacy policy (which can be found on or accessed via the Club's website at www.cpfc.co.uk or can be provided upon written request to the Club).

    9.3 The invalidity or partial invalidity of any provision of these Conditions of Issue shall not prejudice or affect the remainder of these Conditions of Issue, which shall continue in full force and effect. If any invalid, unenforceable or illegal provision of this agreement would be valid, enforceable and legal if some part of it were deleted, the provision shall apply with the minimum modification necessary to make it legal, valid and enforceable.

    9.4 The Club's failure to exercise, or delay in exercising, any right, power or remedy provided by these Conditions of Issue or by law shall not constitute a waiver of that right, power or remedy.

    9.5 The Terms and Conditions of Entry constitute the entire agreement between the Club and the Home Match Ticket holder and neither the Club nor the Home Match Ticket holder shall have any claim or remedy in respect of any statement, representation, warranty or undertaking made by or on behalf of any other party in relation to the Terms and Conditions of Entry which is not set out therein.

    9.6 If there is any conflict, ambiguity or inconsistency between any provision of these Conditions of Issue and any provision of the Ground Regulations, the relevant provision of these Conditions of Issue shall take precedence.

    9.7 Notwithstanding any other provision in these Conditions of Issue and with the exception of any Football Authority, no other person other than you or the Club has any rights under the Contracts (Rights of Third Parties) Act 1999 to rely on or enforce any term of these Conditions of Issue. Nothing in these terms and conditions shall affect any right or remedy of a third party that exists or is available other than as a result of the aforementioned Act.

    9.8 These Conditions of Issue and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of England and Wales. The parties hereby submit to the exclusive jurisdiction of the Courts of England and Wales in relation to any dispute or claim arising out of or in connection with these Conditions of Issue (including in relation to any non-contractual disputes or claims).


    10. Definitions

    In the Conditions of Issue the following words and phrases shall have the following meanings:

    "Conditions of Issue"
    means these terms and conditions governing the issue and use of a Home Match Ticket.

    "Football Authority"
    means each of the Premier League, The Football League, The Football Association, The Football Association of Wales, FIFA, UEFA and other relevant governing body of association football.

    "Ground"
    means the football stadium and all other locations owned, occupied or utilised by the Club.

    "Ground Regulations"
    means those ground regulations issued by the Club from time to time that set out the terms and conditions upon which spectators are granted entry to the Ground which can be found on or accessed via the Club's website at www.cpfc.co.uk or can be provided upon written request to the Club.

    "Guest"
    means a relative, friend, colleague and/or companion to the disabled who would be entitled to purchase a Home Match Ticket under the Terms & Conditions of Entry.

    "Home Match Ticket"
    means a printed paper ticket or any other form of ticket (and/or any rights arising out of or in connection with any of the foregoing) for admission to the Match.

    "Match"
    means that Premier League football match in which the Club participates and that takes place at the Ground during Season 2016-2017 as designated upon the ticket to which these Conditions of Issue apply.

    "Material"
    means any audio, visual or audio-visual material or any information or data.

    "Terms & Conditions of Entry"
    means each of the rules and regulations of any Football Authority; the Ground Regulations; and the Conditions of Issue.

    "Visiting Club"
    means the football club playing against the Club.

    AWAY MATCH TICKET CONDITIONS OF ISSUE


    1. Issue of Away Match Ticket

    1.1 The issue of an Away Match Ticket and subsequent access to the Ground is subject to the Terms & Conditions of Entry (which can be found on – or accessed via – the Club's website at www.cpfc.co.uk or can be provided upon written request to the Club).

    1.2 Away Match Tickets are for the use of supporters of the Visiting Club only. By applying for an Away Match Ticket and/or using the same you hereby warrant and represent that you are a supporter of the Visiting Club and/or that you are not a supporter of the Club.


    2. Admission to the Ground

    2.1 By purchasing and/or accepting and/or holding an Away Match Ticket and/or using an Away Match Ticket to gain access to the Ground, you: (a) certify that you have read, understood and accepted; (b) agree to be bound by and to comply with; and (c) agree to bring to the attention of others, as required below, the Terms & Conditions of Entry.

    2.2 An Away Match Ticket permits you to occupy the seat indicated on the Away Match Ticket or such other alternative seat of equivalent value as the Club may allocate to you at its reasonable discretion. All access to the Ground pursuant to an Away Match Ticket shall be for the purposes of private enjoyment of the Match only, not for any commercial purpose (and no authorisation is given or implied in respect of the carrying out of any commercial activities).

    2.3 Nothing in these Conditions of Issue shall constitute or imply any entitlement to occupy the seat indicated on the Away Match Ticket in any subsequent Match or season.

Any person acting in breach of this provision may have such equipment or technology confiscated and/or will be required to deliver up any tapes, films, disks, memory cards, memory sticks or other recordings of the Material (and all copies thereof) in whatever form, to the Premier League and/or the Club and the copyright, database right and all other rights, title and interest in and to all Material is hereby assigned to the Premier League, including by way of present assignment of future copyright pursuant to section 91 of the Copyright, Designs and Patents Act 1988. In the event that you and/or your Guest(s) are unable to use any Away Match Ticket then you may transfer that Away Match Ticket(s) to a natural person who is known to you personally and who would be entitled (under the Terms & Conditions of Entry and otherwise) to purchase such Away Match Ticket and attend such Match PROVIDED THAT such transfer takes place in consideration of no payment or benefit in excess of the face value of the Away Match Ticket, and such transfer does not take place in the course of any business or for the purpose of facilitating any third party’s business. Such transfer will be subject to the Terms & Conditions of Entry which will (save for any rights to transfer under this clause) apply to and bind the transferee as if he was the original purchaser of the Away Match Ticket (and you must inform the transferee of this). You will provide the name and address of the transferee when asked to do so by any official, steward or employee of the Club and/or any police officer.

    3.4 The Away Match Ticket will remain the property of the Club at all times and must be produced together with evidence of your identity if required to do so by any official, steward or employee of the Club or any police officer. The Club reserves the right to require the immediate return of the Away Match Ticket at any time.

Any person seeking to use an Away Match Ticket in breach of the Terms and Conditions of Entry in order to gain entry to the Ground or remain at a Match will be considered to be a trespasser and will be refused entry to, or ejected from, the Ground in respect of a particular Match and/or may have his/her Away Match Ticket cancelled or withdrawn. In the event of any cancellation and withdrawal in accordance with this clause 3.5, no refund shall be payable. The Club further reserves its right to take any legal or disciplinary action against any person(s) as it sees fit in connection with such matters, including a claim for an account of any profits made from an unauthorised use of the Away Match Ticket.


    4. Changes to Dates, Postponements and Abandonments

    4.1 No guarantees can be given by the Club that the Match will take place at a particular time or on a particular date. Subject to clause 4.2 to 4.3 below, the Club reserves the right to reschedule any Match without notice and without any liability whatsoever.

    4.2 In the event of the postponement or abandonment of the Match prior to kick off, you will be entitled to receive the equivalent ticket for the subsequent re-arranged Match via such application procedure as the Club stipulates.

    4.3 In the event of the abandonment of the Match after kick off you will be entitled to receive half price admission in the event that the Match is rearranged via such application procedure as the Club stipulates.

    4.4 The Club will have no further liability whatsoever in relation to clauses 4.2 to 4.3, including (but not limited to) any indirect or consequential loss or damage, loss of enjoyment or travel/accommodation costs.


    5. Lost or Stolen Away Match Tickets

    5.1 In order to gain admission to the Ground, the Away Match Ticket must be presented in its entirety at the Match.

    5.2 The Club shall not be obliged to issue any replacement for a lost, stolen or destroyed Away Match Ticket.


    6. Cancellation & Withdrawal of Away Match Ticket

    6.1 Without prejudice to any other remedies it may have, the Club shall have the right in the case of any serious or persistent breach of the Terms & Conditions of Entry to cancel and withdraw any Away Match Ticket issued to you. In the event of such cancellation no refund will be paid. Without prejudice to the general nature of the above, the following actions shall constitute serious breach of the Terms & Conditions of Entry:

    6.1.1 smoking in designated non-smoking areas;

    6.1.2 being (or appearing to be) drunk or intoxicated;

    6.1.3 persistent standing in seated areas whilst the Match is in progress;

    6.1.4 the sale or transfer (save as permitted) of an Away Match Ticket to any person;

    6.1.5 the deliberate misuse of an Away Match Ticket;

    6.1.6 any misrepresentation in relation to clause 1.2 above;

    6.1.7 the possession of a banner or flag or wearing of clothing that bears material or slogans that are foul, offensive, obscene, abusive or racist;

    6.1.8 the throwing of any object within the Ground that may cause injury, damage, distress or annoyance to people or property without lawful authority or excuse;

    6.1.9 whether at the Ground, or, travelling to a Match:

    6.1.9.1 the use of foul, offensive, obscene, abusive and/or racist language and/or gestures;

    6.1.9.2 the chanting of anything of an indecent or racist nature;

    6.1.9.3 fighting, or engaging in and/or inciting violence;

    6.1.10 bringing any of the following into the Ground (or using them within the Ground): illegal drugs; other illegal substances; fireworks; firecrackers; smoke canisters; air horns; flares; laser devices; bottles; glass vessels or any item that might be used as a weapon or compromise public safety;

    6.1.11 entering the playing area or any adjacent area to which spectators are not generally admitted without lawful authority or excuse;

    6.1.12 the supply of any misleading or incorrect information in any application;

    6.1.13 any breach of clauses 2.3, 2.4 or 2.5 above; and

    6.1.14 any failure to pay or default of payment in respect of any sums owing to the Club (or any third party) in respect of any Away Match Ticket.

    6.2 The Club may conduct security searches where it has reason to believe that any of the breaches set down in 6.1 has either occurred or may occur.

    6.3 If an Away Match Ticket holder is not 16 years old or over, his/her parent(s) and/or guardian(s) are responsible for his/her actions, conduct and compliance with the Terms and Conditions of Entry.

    6.4 In the event that your Away Match Ticket is withdrawn or cancelled the Club reserves the right to exclude you from any membership scheme maintained or organised by the Club and/or to disqualify you from applying for any Match ticket or season ticket at its discretion, and to notify any Football Authority and/or other football clubs of such exclusion and/or disqualification (and the reason(s) for such exclusion and/or disqualification).


    7. Filming, photography and taping

    7.1 All Away Match Ticket holders who enter the Ground acknowledge that photographic images and/or audio, visual and/or audio-visual recordings and/or feeds (and/or stills taken therefrom) may be taken of them and may also be used, by way of example and without limitation, in televised coverage of the game and/or for promotional, training, editorial or marketing purposes by the Club, the Premier League, or others (including commercial partners and accredited media organisations), and use of an Away Match Ticket to enter the Ground constitutes consent to such use.


    8. Exclusion of Liability

    8.1 The Club hereby excludes any liability for loss, injury or damage to persons/property in or around the Ground except in respect of death or personal injury resulting from any negligence of the Club or any other liability of the Club which cannot be excluded under applicable law.

    8.2 Neither the Premier League nor the Club shall be responsible for any interruptions and/or restrictions to the view of the Match caused by virtue of (i) the position of the seat and/or (ii) the actions of other spectators.


    9. General

    9.1 The Club reserves the right to change these Conditions of Issue from time to time, and shall notify you of such changes if they materially affect your rights as a consumer.

    9.2 You consent to the Club holding and processing data relating to you for administrative and legal purposes. The personal data that you provide to the Club shall be processed, stored and transferred in accordance with the terms of the Club's privacy policy (which can be found on – or accessed via – the Club’s website at www.cpfc.co.uk or can be provided upon written request to the Club).

    9.3 The invalidity or partial invalidity of any provision of these Conditions of Issue shall not prejudice or affect the remainder of these Conditions of Issue, which shall continue in full force and effect. If any invalid, unenforceable or illegal provision of this agreement would be valid, enforceable and legal if some part of it were deleted, the provision shall apply with the minimum modification necessary to make it legal, valid and enforceable.

    9.4 The Club’s failure to exercise, or delay in exercising, any right, power or remedy provided by these Conditions of Issue or by law shall not constitute a waiver of that right, power or remedy.

    9.5 The Terms and Conditions of Entry constitute the entire agreement between the Club and the Away Match Ticket holder and neither the Club nor the Away Match Ticket holder shall have any claim or remedy in respect of any statement, representation, warranty or undertaking made by or on behalf of any other party in relation to the Terms and Conditions of Entry which is not set out therein.

    9.6 If there is any conflict, ambiguity or inconsistency between any provision of these Conditions of Issue and any provision of the Ground Regulations, the relevant provision of these Conditions of Issue shall take precedence.

    9.7 Notwithstanding any other provision in these Conditions of Issue and with the exception of any Football Authority, no other person other than you or the Club has any rights under the Contracts (Rights of Third Parties) Act 1999 to rely on or enforce any term of these Conditions of Issue. Nothing in these terms and conditions shall affect any right or remedy of a third party that exists or is available other than as a result of the aforementioned Act.

    9.8 These Conditions of Issue and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of England and Wales. The parties hereby submit to the exclusive jurisdiction of the Courts of England and Wales in relation to any dispute or claim arising out of or in connection with these Conditions of Issue (including in relation to any non-contractual disputes or claims).


    10. Definitions

    In the Conditions of Issue the following words and phrases shall have the following meanings:

    "Away Match Ticket"
    means a printed paper ticket or any other form of ticket (and/or any rights arising out of or in connection with any of the foregoing) for admission to the Match.

    "Conditions of Issue"
    means these terms and conditions governing the issue and use of an Away Match Ticket.

    "Football Authority"
    means each of the Premier League, The Football League, The Football Association, FIFA, UEFA and other relevant governing body of association football.

    "Ground"
    means the football stadium and all other locations owned, occupied or utilised by the Club.

    "Ground Regulations"
    means those ground regulations issued by the Club from time to time that set out the terms and conditions upon which spectators are granted entry to the Ground which can be found on – or accessed via – the Club’s website at www.cpfc.co.uk or can be provided upon written request to the Club..

    "Guest"
    means a relative, friend, colleague and/or companion to the disabled who would be entitled to purchase an Away Match Ticket under the Terms & Conditions of Entry.

    "Match"
    means that Premier League football match in which the Club participates and that takes place at the Ground during Season 2016-2017 as designated upon the ticket to which these Conditions of Issue apply.

    Material
    means any audio, visual or audio-visual material or any information or data.

    "Terms & Conditions of Entry"
    means each of the rules and regulations of any Football Authority; the Ground Regulations; and the Conditions of Issue.

    "Visiting Club"
    means the football club playing against the Club.

    SEASON TICKET 16/17 TERMS & CONDITIONS


    1 Issue of Season Ticket

    1.1 The issue of a Season Ticket and subsequent access to the Ground is subject to the Terms and Conditions of Entry.

    1.2 Season Tickets are for the use of supporters of the Club only. By applying for the Season Ticket and/or using the same you hereby warrant and represent that you are a supporter of the Club.

    1.3 When you submit an Order, this does not mean we have accepted your order for Season Ticket(s). Our acceptance of the Order and the contract between us will not be formed until we dispatch the tickets to the address stated on the Order.

    1.4 By purchasing, accepting, using, and/or holding a Season Ticket you: (a) certify that you have read, understood and accepted; (b) agree to be bound by and to comply with, and (c) agree to bring to the attention of others as required below, the Terms & Conditions of Entry.


    2 Admission to the Ground

    2.1 A Season Ticket permits you to occupy at the Match the seat indicated on the Season Ticket. Operators at turnstiles will only permit access into the Ground on receipt of the correct Season Ticket. For the avoidance of doubt a Season Ticket does not permit you to occupy the seat indicated on the Season Ticket or entrance to the ground for any home football matches in the Football Association Cup, the Football League Cup, pre-season friendlies or any other domestic or European cup competitions.

    2.2 Save as set out in clause 2.3 below, you shall not capture, log, record, transmit, play, issue, show or otherwise communicate (by digital or other means) any Material in relation to the Match, any players or other persons present in the Ground and/or the Ground, nor may you bring into the Ground or use within the Ground (or provide to, facilitate or otherwise assist another person to use within the Ground) any equipment or technology which is capable of capturing, logging, recording, transmitting, playing, issuing, showing or otherwise communicating (by digital or other means) any such Material. Any person acting in breach of this provision may have such equipment or technology confiscated and/or will be required to deliver up any tapes, films, disks, memory cards, memory sticks or other recordings of the Material (and all copies thereof) in whatever form, to the Premier League and/or the Club and the copyright, database right and all other rights, title and interest in and to all Material is hereby assigned to the Premier League, including by way of present assignment of future copyright pursuant to section 91 of the Copyright, Designs and Patents Act 1988. You further agree (if and whenever required to do so by the Premier League) to promptly execute all instruments and do all things necessary to vest the right, title and interest in such rights to the Premier League absolutely and with full title guarantee. The use of such prohibited equipment may result in the cancellation of the Season Ticket without compensation as well as other legal remedies.

    2.3 Mobile telephones are permitted within the Ground, PROVIDED THAT (a) they are used for personal and private use only (which, for the avoidance of doubt and by way of example only, shall not include the capturing, logging, recording, transmitting, playing, issuing, showing, or any other communication of any Material for any commercial purposes); and (b) no Material that is captured by a mobile telephone or other mobile device may be published or otherwise made available to any third parties including, without limitation, via social networking sites.

    2.4 Save for official Club merchandise and/or other football related clothing worn in good faith, you shall not bring into, use or display within the Ground any sponsorship, promotional or marketing materials. No clothing should be worn that could in any way be seen to promote racial or any form of discrimination which could lead to offence to fellow members of the crowd.

    2.5 You shall not offer or distribute (either free or for sale by any person) within the Ground any consumer article or commercial product of any nature.

    2.6 The Club reserves the right to refuse admission to, or eject from, the Ground any person who fails to comply with the Terms & Conditions of Entry.

    2.7 Nothing in these Terms and Conditions establish or imply any right to renew or occupy the same seat allocated to the Season Ticket in any other season.

    2.8 The Club may from time to time relocate a Season Ticket Holder from their usual allocated seat to an alternative seat within the Ground where this is required (a) for operational reasons (such as and not limited to assisting the redevelopment or refurbishment of any parts of the Ground), (b) to comply with any requirements of any Football Authority in relation to any Match, or (c) the Club, the police or any other applicable authority considers a relocation is required for safety or public order.

    2.9 Without prejudice to the representation at clause 1.2 above, and in light of the Season Ticket holders being grouped together in designated areas, any attempt to gain access to the Ground wearing or carrying apparel (including, without limitation, replica shirts hats and/or scarves) that demonstrate support for the Away Club, may result in admission being refused or you being ejected from the Ground and in such circumstances no refund or alternative seat will be offered.


    3 Use of Season Ticket

    3.1 The Season Ticket is issued for your sole use and you shall not resell, assign or transfer the Season Ticket or the benefit of it to any other person without the prior written consent of the Club. The reference to reselling the Season Ticket includes reference to offering to sell a Season Ticket, exposing a Season Ticket for sale, making a Season Ticket available for sale by another and advertising that a Season Ticket is available for purchase. For the avoidance of doubt (and by way of example only) this Season Ticket may not be offered as a prize in any promotion or competition or transferred, lent or sold to any third party as part of a hospitality or travel package, given to a third party who agrees to buy another good or service or used for any other commercial purpose save as expressly authorised by the Club.

    3.2 The unauthorised sale or disposal of tickets is a criminal offence under section 166 of the Criminal Justice and Public Order Act 1994, as amended by the Violent Crime Reduction Act 2006. The Club will inform the police when it becomes aware that a Season Ticket has been or is being sold or disposed of illegally and will press for charges to be brought against those breaking this law. If you are convicted of a ticket touting offence, or we reasonably suspect you have committed such an offence, we will notify the Premier League who may in turn notify other football clubs, event holders and/or the relevant law enforcement authorities. The information that we share may include your personal details, information about the offence and about ticket purchases (including payment details). We will use this to identify and prevent ticket touting offences and disorder at matches.

    3.3 The Season Ticket will remain the property of the Club at all times and must be produced together with evidence of your identity if required to do so by any official, steward or employee of the Club or any police officer. The Club reserves the right to require the immediate return of the Season Ticket at any time.

    3.4 Season Tickets are strictly NON transferable. If you are unable to attend a Match then you may temporarily allow a Friend to use your Season Ticket for the purpose of allowing that Friend to attend such Match provided always that:

    3.4.1 If, subject to clause 3.5 below, the Season Ticket is a concessionary priced Season Ticket that the Friend meets the criteria of the concessionary priced Season Ticket;

    3.4.2 There is no charge made or paid for that attendance and it is not being made in the course of business or assisting any third party business;

    3.4.3 You are only permitted to do so up to 4 times in the Season;

    3.4.4 Such Friend is a supporter of the Club; and

    3.4.5 Such use will be subject to the Terms and Conditions of Entry which will (save for any rights to allow a Friend to use under this clause) apply to and bind the Friend and you must inform the Friend of this.

    3.5 For any Matches that are held in the evenings midweek (not on a Saturday, Sunday or Public Holiday) a Season Ticket with an under 18s concession may be temporarily used by a Friend who is over 18 years.

    3.6 It is the responsibility of the Season Ticket Holder to check the date and time of all Matches, including any re-scheduled or postponed Matches. The Club will announce dates and times of kick off on the Website, in the match day programmes and in the press and may be altered at short notice.


    4 Pricing and Concessions

    4.1 Season Tickets may be purchased:

    4.1.1 Via the Website;

    4.1.2 In person at The Box Office, or

    4.1.3 By phone on 08712 000071. Calls from a BT landline cost 10p per minute. Calls from a mobile may cost considerably more. Please note that calls may be recorded or monitored to ensure and improve the quality of our services; or

    4.2 From 1st March 2016, Season Tickets may also be purchased through our Season Ticket Instalment Plan which is an interest-free direct debit instalment option. You can obtain an application form for the Season Ticket Instalment Plan:

    4.2.1 Via the Website; or

    4.2.2 From the Box Office.

    4.3 You can submit your completed application form for the Season Ticket Instalment Plan to us:

    4.3.1 By post to the above address; or

    4.3.2 In person at the Box Office at the above address.

    4.4 Your instalment plan application will be considered by our Finance Team and you will be contacted by post with further information about the Season Ticket Instalment Plan if your application has been successful. Specific Terms and Conditions relating to the Season Ticket Instalment Plan can be found in paragraph 5 below.

    4.5 The Club is unable to accept bookings, reservations, purchases and/or applications for the purchase of Season Tickets by email.

    4.6 The Club only accepts payments for Season Tickets as follows:

    4.6.1 By a valid credit card (we do not accept American Express or Diners). A 1.5% surcharge will be applied when payment is made with a credit card;

    4.6.2 By a valid debit card; and

    4.6.3 By cash in Pounds sterling.

    4.7 Season Tickets purchased via the Season Ticket Instalment Plan are payable by monthly direct debit with one initial monthly payment and thereafter the monthly payments will be equally spread until April in the year following your application. You will be required to complete and return a direct debit mandate form. Please ensure that you get your application in as soon as possible so it can be processed quickly and your first payment set up. If there is a delay in your application being processed the number of instalments you have to pay may be reduced from the maximum of 12 to the number of months between your application being processed and April of the following year.

    4.8 The prices payable for Season Tickets are published on the Website or are as otherwise notified by the Club from time to time.

    4.9 All prices for Season Tickets, unless otherwise stated, are inclusive of VAT.

    4.10 The Club always seeks to ensure that pricing and ticketing information in our literature, on the Website and elsewhere in all our communications is correct at all times, but errors may sometimes occur. As soon as the Club becomes aware of any errors in any pricing or descriptions of the tickets and any benefits the Club will inform you as soon as reasonably practicable. The Club will give you the option of reconfirming your order at the correct price and specification or cancelling it. If after making reasonable attempts to do so the Club is unable to contact you it will treat the order as cancelled. If the order is cancelled the Club will provide you with a refund using the payment details you have provided.

    4.11 Subject to condition 4.11, concessionary prices are available for Season Tickets based on the following eligibility:

    4.11.1 SENIORS prices are available to supporters 65 years or older on 1st August 2016

    4.11.2 UNDER 18 prices are available to supporters under 18 years on 1st August 2016

    4.11.3 YOUNG ADULTS prices are available to supporters aged 18, 19, 20 or 21 years on 1st August 2016

    4.11.4 STUDENT prices are available to supporters in full time education on 1st August 2016 and for the Season.

    4.12 The Club reserves the right to request proof of age if applying for any age related concessionary pricing. In addition the Club reserves the right to request proof of full time education if applying for Student concession pricing.

    4.13 A Season Ticket is not refundable or cancellable by you during the course of the Season. The Club, in its absolute discretion, will consider on a case by case basis any requests for a refund on compassionate or exceptional grounds.

    4.14 If you die the Club will take into account your wishes concerning a transfer of your Season Ticket but it is under no obligation to do so.

    4.15 For the safety of infants and all supporters, Season Tickets are not available for infants under the age of 2 or babes in arms at any time during the Season and no infant under the age of 2 or babes in arms is allowed entry to the Ground to attend a Match.


    5 Terms and Conditions relating to the Season Ticket Instalment Plan

    5.1 In entering into the Season Ticket Instalment plan with us you agree that:

    5.1.1 you accept these Terms and Conditions, contained in this document and the Terms and Conditions of Entry.

    5.1.2 you are over 18 years of age;

    5.1.3 the details you have provided to us are true and complete;

    5.1.4 you will inform us as soon as possible of any changes in your name, home address and bank details; and

    5.1.5 you give consent for us to write to you giving you advance notice of your option to renew your season ticket for the following football season.

    5.2 Repayments

    5.2.1 You agree to make payments to us by direct debit on the repayment dates;

    5.2.2 If the attempt to collect repayment by direct debit on a repayment date is unsuccessful we will contact you by phone, email and/or SMS message and find out why you have been unable to make your repayment and reschedule it or take payment by other means. If you instruct us to collect any amount outstanding by debit card we may do so using card details that you provide.

    5.2.3 You can cancel the direct debit by contacting your bank directly. If you cancel your direct debit you must promptly notify our Finance Team at directdebitteam@cpfc.co.uk and ensure that you have made alternative payment arrangements prior to the repayment dates to avoid missing a repayment and breaching these Terms and Conditions. The direct debit is subject the direct debit guarantee.

    5.3 If you fail to make repayment on a scheduled payment date we may suspend or withdraw your Season Ticket in accordance with clause 11.2 below.

    5.4 The Season Ticket Instalment Plan is not a regulated consumer credit agreement.

    5.5 The Club reserves the right to refuse Season Ticket Instalment Plan applications. In the event that an application to pay for a Season Ticket using the Season Ticket Instalment Plan is refused the Season Ticket can be purchased as normal using one of the other methods of payment.


    6 Family Zone

    6.1 The Club’s Family Zones are located in the Main stand at Blocks A and J and in the Whitehorse Lane stand.


    7 Disabled Supporters.

    7.1 The Club has a pricing policy for Supporters with Disabilities. A Supporter with Disabilities wishing to buy a Season Ticket and who can provide the Club with proof of their disability shall be able to apply to purchase a Season Ticket at the then rate available for Supporters with Disabilities. Please contact our Disabled Liaison Officer at 020 8768 6080 for full details.

    7.2 Any supporter wishing to purchase a Season Ticket under this policy will need to provide proof of eligibility by providing one of the following:

    7.2.1 A copy of a statement/award letter of receipt of Disabled Living Allowance at the high or medium rate for mobility or care; and

    7.2.2 A copy of a statement of receipt of Enhanced Person Independent Payment (PIP) for mobility.

    7.3 The Club allows a Supporter with Disabilities to bring a Personal Assistant to every Match and the Club will use all reasonable efforts to provide the Personal Assistant with a seat next to the Supporter with Disabilities, but if this is not possible the Club will provide the closet available seat to the Supporter with Disabilities.

    7.4 A Personal Assistant is not a Season Ticket Holder in their own right. The Personal Assistant is not able to attend a Match unless accompanied by the Supporter with Disabilities who is a Season Ticket Holder. When a Season Ticket Holder who is a Supporter with Disabilities is unable to attend a Match the Personal Assistant can only attend by purchasing a ticket for the applicable Match.


    8 Lost or Stolen Season Tickets

    8.1 In order to gain admission to the Ground the Season Ticket must be presented in its entirety at every Match.

    8.2 The Club is not responsible for a lost, stolen, forgotten, damaged or destroyed Season Ticket. The Club may at its complete discretion provide you with a duplicate Season Ticket subject to payment by you of a non-refundable administration fee of up to £20.00 before issuing the duplicate Season Ticket.

    8.3 The Club reserves the right to seek proof of identity and to call for all reasonable evidence of the need for a replacement Season Ticket before issuing any duplicate Season Ticket.


    9 Change of Details

    9.1 If you change your address, payment details, and/or contact details please notify the Club as soon as reasonably practicable via your account on the Website or by emailing the box office at boxoffice@cpfc.co.uk. Proof of identity and address may be required.


    10 Changes to dates, refunds and exchanges

    10.1 No guarantees can be given by the Club that any Match will take place at a particular time or on a particular date. The Club reserves the right to cancel or reschedule any Match without notice and without any liability whatsoever.

    10.2 Your Season Ticket will enable you to attend any re-scheduled Match.


    11 Cancellation & Withdrawal of Season Ticket

    11.1 Without prejudice to any other remedies it may have, the Club shall have the right in the case of any serious or persistent breach of the Terms & Conditions of Entry to (a) cancel and withdraw any Season Ticket issued to you, and/or (b) refuse entry or eject the user of the Season Ticket at any Match. In the event of such cancellation, refusal or ejection no refund will be paid for the unexpired portion of the Season Ticket and/or for any particular Match. Without prejudice to the general nature of the above the following actions shall constitute serious breach of the Terms & Conditions of Entry:

    11.1.1 Smoking in designated non-smoking areas;

    11.1.2 persistent standing in seated areas whilst the Match is in progress;

    11.1.3 sale or transfer (save as permitted) of this Season Ticket to any person;

    11.1.4 deliberate misuse of the Season Ticket;

    11.1.5 any misrepresentation in relation to condition 1.2;

    11.1.6 persistent swearing during the Match;

    11.1.7 the throwing of any object within the Ground that may cause injury, damage, distress or annoyance to people or property without lawful authority or excuse;

    11.1.8 being (or appearing to be) drunk or intoxicated;

    11.1.9 whether at the Ground or, travelling to or from a Match:

    (a) the use of foul, obscene, abusive, racist and/or discriminatory language and/or gestures;

    (b) the chanting of anything of an indecent, racist and/or discriminatory nature;

    (c) fighting or engaging in and/or inciting violence;

    11.1.10 the possession of a banner or flag that bears materials or slogans that are offensive, obscene, abusive, racist or discriminatory;

    11.1.11 bringing the Ground ( or using within the Ground): illegal drugs, other illegal substances, fireworks, firecrackers, smoke canisters, air horns, flares, laser devices, bottles, glass vessels or any item that might be used as a weapon or compromise public safety;

    11.1.12 entering the playing area or any adjacent area to which spectators are not generally admitted without lawful authority or excuse;

    11.1.13 the supply of any misleading or incorrect information in any application;

    11.1.14 any breach of clauses 2.2, 2.3 or 2.4; and

    11.1.15 any failure to pay or default of payment in respect of any sums owing to the Club (or any third party) in respect of any Season Ticket.

    11.2 In relation to Season Tickets obtained through the Season Ticket Instalment Plan and in addition to the Terms and Conditions of Entry, you will be in breach of the terms and conditions of the Season Ticket Instalment Plan, as set out in paragraph 5 above, if you fail to pay any repayments as specified under the Season Ticket Instalment Plan. In such circumstances we reserve the right to:

    11.2.1 suspend the use of your Season Ticket and the ability to purchase additional tickets until payment of any outstanding sums under the credit agreement are received;

    11.2.2 terminate the Season Ticket Instalment Plan;

    11.2.3 permanently withdraw your Season Ticket; and/or

    11.2.4 disqualify you from applying for any subsequent Season Ticket Instalment Plan organised by the Club.

    11.3 In the event that your Season Ticket is withdrawn or cancelled the Club reserves the right to exclude you from any membership scheme maintained or organised by the Club and/or to disqualify you from applying for any Match ticket or season ticket at its discretion and to notify any Football Authority and/or other football clubs of such exclusion and/or disqualification and the reason for such exclusion and/or disqualification.

    11.4 If a Season Ticket holder is not 18 years or older, his/her parents and/or guardians are responsible for his/her actions, conduct and compliance with the Terms and Conditions of Entry.

    11.5 The Club may conduct security searches where it has reason to believe that any of the breaches set down in 11.1 has either occurred or may occur.


    12 Data Protection and How we use Information about You

    12.1 You acknowledge and agree that any personal data provided by you in the application, purchase and use of a Season Ticket shall be collected, stored and used by the Club in accordance with the Data Protection Act 1998 and the Club’s Privacy Policy which is available on the Website.

    12.2 All Season Ticket holders who enter the Ground acknowledge that photographic images and/or audio, visual and/or audio-visual recordings and/or feeds (and/or stills taken therefrom) may be taken of them and may also be used, by way of example and without limitation, in televised coverage of the game and/or for promotional, training, editorial or marketing purposes by the Club, the Premier League, or others (including commercial partners and accredited media organisations), and use of a Season Ticket to enter the Ground constitutes consent to such use.


    13 Exclusion of Liability

    13.1 Neither the Club nor the Premier League shall have any liability to any Season Ticket Holder, or any Friend, or any Guest or Personal Assistant for (a) any interruptions and/or restrictions to the view of any Match; and/or (b) any impact on their enjoyment of any Match; which in each case is caused by the position of the allocated seat, and/or other ticket holders or spectators in the Ground.

    13.2 The Club shall have no liability for any non-delivery or late delivery of any Season Ticket resulting from the acts or omissions of any postal service supplier.

    13.3 In the event of cancellation or re-schedule of any Match, the Club will have no liability whatsoever, including for any indirect or consequential loss or damage, loss of enjoyment or travel/accommodation costs.

    13.4 To the maximum extent permitted by law, the Club hereby excludes any liability for loss, injury or damage to persons/property in or around the Ground.

    13.5 For the avoidance of doubt we do not exclude or limit in any way our liability for:

    13.5.1 death or personal injury caused by our negligence or the negligence of our employees; or

    13.5.2 any other conduct for which liability may not be excluded or limited as a matter of English law.


    14 Events Outside Our Control

    14.1 We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under these Terms and Conditions that is caused by an Event Outside Our Control.

    14.2 An Event Outside Our Control means any act or event beyond our reasonable control, including without limitation strikes, lock-outs or other industrial action by third parties, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster, power failure, governmental or local authority or football authority regulations and requirements, or failure of public or private telecommunications networks.

    14.3 If an Event Outside Our Control takes place that affects the performance of our obligations under these Terms and Conditions:

    14.3.1 We will contact you as soon as reasonably possible to notify you; and

    14.3.2 Our obligations under these Terms and Conditions will be suspended and the time for performance of our obligations will be extended for the duration of the Event Outside Our Control.


    15. General

    15.1 If the Club fails to insist that you perform any of your obligations under these Terms and Conditions, or if the Club does not enforce its rights against you, or if the Club delays in doing so, that will not mean that the Club has waived its rights against you and will not mean that you do not have to comply with those obligations. If the Club does waive a default by you, the Club will only do so in writing, and that will not mean that the Club will automatically waive any later default by you.

    15.2 Each of the paragraphs of these Terms and Conditions operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect. If any unlawful provision of the Terms and Conditions would be lawful if some of it were deleted, the provision shall apply with the minimum modification necessary to make it lawful.

    15.3 The Club reserves the right to vary these Terms and Conditions from time to time, provided that the benefits received by any Season Ticket holder are not less than those already received, or are substantially similar to those already received by any Season Ticket before the variation is made.

    15.4 Notwithstanding any other provision in these Terms and Conditions and with the exception of any Football Authority, no other person other than you or the Club has any rights under the Contracts (Rights of Third Parties) Act 1999 to rely on or enforce any term of these Terms and Conditions. Nothing in these Terms of Conditions shall affect any right or remedy of a third party that exists or is available other than as a result of the aforementioned Act.

    15.5 These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales. The parties hereby submit to the non-exclusive jurisdiction of the Courts of England and Wales.


    16 Definitions

    In these terms and conditions the following words and phrases shall have the following meanings:

    “Away Club” the football club playing against the Club.

    “Competitions” the Premier League and the Football League Championship.

    “Club/we/our/us” CPFC Limited (07270793) of Selhurst Park, Holmesdale Road, London SE25 6PU.

    “Football Authority” each of the Premier League, The Football League, The Football Association, The Football Association of Wales, FIFA, UEFA and other relevant governing body of association football.

    “Friend” a person who is a friend, family member, or colleague.

    “Ground” the football stadium at Selhurst Park, Holmesdale Road, London SE25 6PU.

    “Ground Regulations” those ground regulations issued by CPFC from time to time that set out the terms and conditions upon which spectators are granted entry to the Ground (copies of which are on display at the Ground and on the Website).

    “Matches” all home football league matches in which the Club’s men’s first XI play at the Ground during the Season in any of the Competitions.

    “Material” any Premier League football match in which the Club participates and that takes place at the Ground during Season 2016/17.

    “Opening Times” means at least 1.5 hours prior to the scheduled kick off time for each Match and up to at least one hour after the final whistle for each Match. The Club reserves the right to alter the foregoing times, at its discretion.

    “Order” the application or order by you for a Season Ticket.

    “Personal Assistant” an individual who is responsible for the care of a Supporter with Disabilities.

    “Premier League” the Football Association Premier League.

    “Season” the 2016/17 professional football season as determined by The Premier League or the Football League as relevant.

    “Season Ticket” the electronic entry smart card or other form of ticket or card provided by the Club entitling admission to Matches.

    “Season Ticket Holder” a holder of a Season Ticket.

    “Season Ticket Instalment Plan” the interest – free direct debit instalment plan under which a Season Ticket Holder can purchase their Season Ticket(s) subject to the terms and conditions contained in paragraph 5 above.

    “Supporter with Disabilities” any supporter of the Club who has a physical or mental impairment that has a ‘long term’ or ‘substantial’ negative effect on their ability to carry out normal day to day activities.

    “Terms and Conditions” these terms and conditions governing the issue and use of a Season Ticket.

    “Terms and Conditions of Entry” each of the rules and regulations of FIFA, UEFA, The Football Association Limited, the Football Association of Wales, the Football League and/or any other relevant governing body of association football, the Ground Regulations and these Terms and Conditions, as each may be amended from time to time.

    “Website” means the Club’s website at www.cpfc.co.uk.


    Section B - Main Stand Benefits Terms and Conditions

    In addition to the general terms and conditions set out in Section A of these Terms and Conditions, the terms and conditions set out in this section B shall apply to Season Ticket Holders who have purchased any of the following options:


    1 Stephenson Lounge Benefits

    1.1 If you are a Season Ticket Holder with seats in Blocks E & F in the Main Stand you shall be entitled to exclusive access to the Stephenson Lounge throughout the Opening Times.

    1.2 The Club shall provide (itself or through a third party service provider engaged by the Club) a refreshment service in the Stephenson Lounge during the Opening Times (excluding those times in which a Match is in play).

    1.3 The costs of all refreshments consumed by you shall be paid by you to the refreshment supplier in the Stephenson lounge at the time of ordering or consuming.


    2 Wright & Bright Bar Benefits

    2.1 If you are a Season Ticket Holder with seats in Blocks G or H in the Main Stand you shall be entitled to access to the Wright & Bright Bar throughout the Opening Times.

    2.2 The Club shall provide (itself or through a third party service provider engaged by the Club) a refreshment service in the Wright & Bright Bar during the Opening Times (excluding those times in which a Match is in play).

    2.3 The costs of all refreshments consumed by you shall be paid by you to the refreshment supplier in the Wright & Bright Bar at the time of ordering or consuming.


    3 Glaziers Lounge Benefits

    3.1 If you are a Season Ticket Holder with seats in Blocks B, C or D in the Main Stand you shall be entitled to access to the Glaziers Bar throughout the Opening Times.

    3.2 The Club shall provide (itself or through a third party service provider engaged by the Club) a refreshment service in the Glazier Bar during the Opening Times (excluding those times in which a Match is in play).

    3.3 The costs of all refreshments consumed by you shall be paid by you to the refreshment supplier in the Glazier Bar at the time of ordering or consuming.


    4 Malcolm Allison Lounge Benefits

    4.1 If you are a Season Ticket Holder in the Director’s Box with a Malcom Allison package you shall be entitled to exclusive access to the Malcolm Allison Lounge throughout the Opening Times.

    4.2 The Club shall provide (itself or through a third party service provider engaged by the Club) a refreshment service in the Malcolm Allison Lounge during the Opening Times (excluding those times in which a Match is in play).

    4.3 Subject to 4.5 below, the costs of all refreshments consumed by you shall be paid by you to the respective refreshment supplier in the Malcolm Allison lounge on the day of a Match at the time of ordering or consuming.

    4.4 A Season Ticket Holder in the Director’s Box with a Malcolm Allison package will receive £100 worth of refreshment credited to their Season Ticket which can then be spent during the Season by scanning against the tills at the refreshment services in the Malcolm Allison Lounge. At the end of the Season you will lose any balance of this credited sum which has not be spent by you.

    4.5 A Season Ticket Holder in the Director’s Box who has purchased a seasonal food/dining package shall be entitled to a buffet meal served in the Malcolm Allison lounge before the Match commences.


    5 Vice Presidents Lounge Benefits

    5.1 If you are a Season Ticket Holder in the Directors Box with a Vice Presidents package you shall be entitled to exclusive access to the Vice Presidents Lounge respectively throughout the Opening Times.

    5.2 The Club shall provide (itself or through a third party service provider engaged by the Club) a refreshment service in the Vice Presidents Lounge during the Opening Times (excluding those times in which a Match is in play).

    5.3 You will be entitled to a complimentary buffet meal served in the Vice President’s lounge before the Match commences.

    5.4 The costs of all drinks consumed by you shall be paid by you to the Vice Presidents lounge refreshment supplier in the Vice Presidents Lounge on the day of the Match at the time of ordering or consuming.

    5.5 A Season Ticket Holder in the Director’s Box with a Vice Presidents Lounge package will receive £100 worth of refreshment credited to their Season Ticket which can then be spent during the Season by scanning against the tills at the refreshment services in the Vice Presidents Lounge. At the end of the Season you will lose any balance of this credited sum which has not be spent by you.


    6 Speroni’s Restaurant Seasonal Benefits

    6.1 If you are a Season Ticket Holder with a Speroni’s Restaurant package you shall be entitled to access the Speroni’s Restaurant and bar throughout the Opening Times.

    6.2 You will be entitled to:

    6.3 A complimentary waitress service four-course meal with a choice of starter and main and complimentary half a bottle of house white/red wine per person with your meal in Speroni’s Restaurant served on each Match day during the Opening Times (excluding those times when a Match is in play); and

    6.4 A Complimentary Match day programme.

    6.5 The costs of all drinks ordered or consumed by you and your Guest(s) shall be paid by you to Speroni’s.


    7 2010 Club Seasonal Benefits

    7.1 Season Ticket Holders of the 2010 Club shall be entitled to exclusive access to the 2010 Club throughout the Opening Times

    7.2 The Club shall provide the following benefits at each Match:

    7.3 Complimentary champagne reception upon arrival prior to the Match;

    7.4 Complimentary food, wines, beers and soft drinks served throughout the Opening Times (excluding those times in which a Match is in play);

    7.5 A Complimentary Match day programme; and

    7.6 Use of an Exclusive business area of the 2010 lounge with Wi-Fi facilities.


    8 Use of Hospitality

    8.1 If more than one Season Ticket with a hospitality package described in paragraphs 6 and 7 is issued to you, one Season Ticket must be retained by you for personal use and the remainder may be lent on a Match by Match basis to a Friend for his/her/their personal use only (“Guest(s)”), PROVIDED THAT:

    8.2 Such loan takes place in consideration of no payment or benefit in excess of the face value of the Season Ticket for that Match;

    8.3 Such loan to any Guest(s) will be subject to the Terms and Conditions of Entry which will (save for any rights to loan under this clause) apply to and bind each Guest (and you must inform the Guest(s) of this);

    8.4 Such loan does not take place in the course of any business or for the purpose of facility any third party’s business (other than, in each case, to the extent you are NOT a consumer and only for corporate hospitality which is not in itself a business activity of that business); and

    8.5 You will provide the name and address of your Guest(s) when asked to do so by any official, steward or employee of the Club and/or any police officer.


    9 General

    9.1 Only food and drink purchased from the Club or provided by the Club in the bars, lounges and hospitality facilities described in paragraphs 1-7 above may be consumed in those facilities respectively.

    9.2 Season Ticket Holders shall at all times comply with any Club requirements and all statutory requirements which may from time to time be in force relating to the consumption of alcohol at football grounds and otherwise.

    9.3 Season Ticket Holders shall at all times use the bars, lounges and hospitality facilities referred to in paragraphs 1-7 above in a proper and lawful manner and not so as to cause nuisance, damage, disturbance, annoyance, interference or inconvenience to the Club or any other person (for the avoidance of any doubt, this shall include acting at all times in a respectful manner to the opposition team’s supporters, directors, guests and employees).

    9.4 Season Ticket Holders (and their Guest(s) where applicable) must adhere to any specific dress code in place for their particular bar, lounge and hospitality facility described in paragraphs 1-7 above as notified to them by the Club.



    CPFC LIMITED ('CLUB')


    MEMBERSHIP TERMS & CONDITIONS 2016/17

    The following terms and conditions (the "Terms and Conditions") apply to all purchases of a Membership (as defined below). Before purchasing, these Terms and Conditions are to be read in conjunction with the Conditions of Entry (as defined below). Purchase of a Membership and use of the benefits it confers are subject to these Terms and Conditions and the Conditions of Entry and all Members agree to be bound by the same.

    PART I - General Terms and Conditions


    1.
    Definitions

    In these Terms and Conditions, the following words and phrases shall have the following meanings (unless stated otherwise):

    "Address" the addresses of Members provided to the Club upon application for the purchase of a Membership, or such other addresses as may be notified by Members to the Club in accordance with condition 11 below;

    "Club" CPFC Limited;

    "Conditions of Entry" the rules and regulations of each of FIFA, UEFA, the Football Association, the Premier League, the Football League, Home Ticket Terms and Conditions and the Ground Regulations;

    "Cup Competition" each of the League Cup, the FA Cup and the UEFA Competitions;

    "Cup Match" any match in a Cup Competition in which the Team participates during the Season;

    "Football League or Football League Limited" a limited liability company incorporated in England with registered number 00086012 which operates and manages the second tier of professional association football in England and Wales comprising the championship and two further divisions known as the First Division and the Second Division or however such second tier may otherwise be constituted after any restructuring of such divisions during the Membership Term;

    "Ground" Selhurst Park Stadium, London SE25 6PU (or such other ground to which the Club relocates on a temporary or permanent basis to the extent that the Selhurst Park Stadium is unavailable for use by the Club);

    "Ground Regulations" the ground regulations issued by the Club from time to time that set out the terms and conditions upon which spectators are granted entry to the Ground, a copy of which is available on the Website;

    "Home Match" a Match played at the Ground;

    "Home Ticket Terms and Conditions" the standard terms and conditions applicable to the purchase of tickets and attendance at a Home Match, a copy of which is available on the Website;

    "Loyalty Points" points earned by Members under the Club's ticket loyalty point scheme in place from time to time;

    "Match" any Premier League, Football League match, Cup Match or friendly match played by the Team in the Season;

    "Member" a person who is registered as an official member of the Club's Membership scheme, whether a Gold, Silver, International or Junior Member and is entitled to the Membership Benefits, subject to these Terms and Conditions;

    "Membership" the membership of an official scheme of membership operated by the Club;

    "Membership Benefits" in respect of each Membership, the ability to apply for the purchase of Match tickets in accordance with Condition 4 and the additional benefits to which a Member is entitled, as set out in Part II of these Terms and Conditions;

    "Membership Card" the card (and any replacement thereof) issued to each Member by the Club which, amongst other things, admits the Member into the Ground at Matches which that Member is entitled to attend;

    "Membership Price" the price payable for each Membership as set out on the Website or as otherwise notified by the Club from time to time;

    "Membership Term" each period of Membership which begins upon the date of purchase of the Membership and runs until the end of the Season;

    "Premier League" the association football league of leading professional association football clubs operated and managed by the Football Association Premier League Limited or any replacement thereof;

    "Purchaser" a person purchasing any number of Memberships;

    "Season" means the playing season of competitive professional matches played by the Team in all competitions for the 2016/17 season which shall ordinarily commence in or around 1 August of 2016 and end in May 2017;

    "Team" the Club's men's first team squad of full-time, professional association football players;

    "Website" the Club's website at www.cpfc.co.uk.


    2. Types of Membership.

    2.1 Memberships will be made available to individuals at the Club's sole discretion. The Club currently has five Memberships as follows (as may be amended by the Club from time to time):

    a. Gold Membership, available to individuals aged 18 or over at the date of initial purchase of the Membership;

    b. International Membership available to individuals aged 18 or over at the date of initial purchase of the Membership;

    c. Junior Membership available to individuals aged 17 or under at the date of initial purchase of the Membership;

    d. Junior Membership plus, available to individuals aged 17 or under at the date of initial purchase of the Membership; and

    e. Silver Membership available to all individuals.

    2.2. If, during the course of a Membership Term, a Member reaches an age which would place that Member outside the age limits for his/her current Membership (e.g., a Junior Member turns 18), such Member shall continue with his/her current Membership (and continue to be entitled to the same Membership Benefits associated with that Membership) until the expiry or termination of that Membership Term. If a Member subsequently purchases Membership for a further period the Member should upgrade to the appropriate Membership for his/her age at that time.

    2.3. Memberships are available for purchase by supporters of the Club only. By applying to purchase one or a number of Memberships and/or using a Membership Card, the Purchaser hereby warrants and represents that they (and any person they are buying a Membership for or who uses the Membership Card) are a supporter of the Club.

    2.4 . The Membership of each Member shall be for the duration of the Membership Term.


    3. Price and Payment

    3.1. The price payable for each Membership shall vary depending on the specific type of Membership purchased. The price shall be as set out on the Website and/or as otherwise notified by the Club from time to time and communicated to an individual prior to any purchase. Unless expressly stated otherwise, all prices are inclusive of VAT.

    3.2. By applying to subscribe to a Membership, a Purchaser is making an offer to the Club. A contract for the supply of the Membership shall be created when the required payment has been received (which, for the avoidance of doubt, means when cleared funds are received) by the Club and the Club has issued a confirmation of purchase.

    3.3 . Any individual purchasing a Membership for a third party shall be deemed to be acting with the authority of each Member for whom they are making the purchase, including acting with the authority of each such Member to agree to these Terms and Conditions on their behalf. Following the purchase of a Membership the Club shall only communicate with the registered Member (regardless of whether such Membership was bought on their behalf or otherwise).

    3.4. Memberships may be purchased using any of the following purchase methods:

    a. via the CPFC ticket Website https://www.cpfctickets.com/memberships.aspx;

    b. over the telephone by calling +44 (0) 8712 000071 (calls from a BT landline cost 10p per minute and calls from a mobile may cost considerably more. Please note that calls may be recorded or monitored to ensure and improve the quality of our service); or

    c. in person at the ticket office at the Ground.

    3.5. Where a Junior and/or Junior PLUS Membership is purchased the following terms shall apply:

    a. if the Purchaser is a prospective Junior Member or Junior PLUS Member, the Purchaser shall be required to (i) confirm as part of the purchase process that they have the consent of their parent and/or legal guardian to their purchase of the Membership and that the parent and/or legal guardian agrees to the Member being subject to these Terms and Conditions. Junior and Junior PLUS Members under the age of 13 may additionally be required to provide the email address of their parent and/or legal guardian as part of the purchase process at which point an email containing details of the purchase shall be sent to the parent / legal guardian's email address and the parent/legal guardian shall be given the opportunity to object to the purchase of the Membership. If the parent/legal guardian does so object, they should contact the Box Office, and request that the purchase of the Membership be cancelled. Upon cancellation a full refund shall be given to the Purchaser using the payment details provided on purchase; and

    b. if the Purchaser is the parent and/or legal guardian of a prospective Junior Member or Junior PLUS Member, they shall confirm as part of the purchase process that they consent to the Member being subject to these Terms and Conditions.

    3.6. The sale of Memberships is subject to the Purchaser providing the Club with full payment of the relevant price.

    3.7. The Club only accepts payments made for Memberships as follows: by cash, debit card or valid credit card (the Club does not accept American Express or Diners).

    3.8. The Club always tries to ensure that pricing and ticketing information provided by the Club (including but not limited to, on the Website, on any literature or by a sales representative) is correct, but errors may occur. Upon the Club becoming aware of any pricing or product description error in relation to any Memberships which has been purchased, the Club will endeavour to inform the Purchaser as soon as reasonably practicable using the contact details provided to the Club. The Club will then provide the Purchaser with the option of reconfirming the order at the correct price/product description or cancelling the order. If the Club is unable to contact the Purchaser having made reasonable attempts to do so, the Club will treat the order as cancelled.


    4. Match Ticket Applications (for the Season) and other benefits of Membership

    4.1 . Following purchase of a Membership, where invited by the Club to do so and subject to availability, a Member shall have the opportunity to apply to purchase tickets for Matches. The availability for tickets for Matches will be publicised by the Club on a match by match basis.

    4.2 . If an International Membership has been purchased those Members shall at any time, following release of the fixture list for Premier League Matches, have the opportunity to notify the Club of which Premier League Home Matches it would like to request a ticket for, subject always to availability at the point of notification.

    4.3 . If a Gold Membership has been purchased any invitation made by the Club to buy Premier League Home Match tickets shall be offered to Members with a Gold Membership one (1) day before Junior and Silver Members are invited to purchase. This benefit does not give access ahead of the International Member priority reservation ticket access referred to in condition 4.2 above nor any similar benefit and/or priority that may be given to the Club's season ticket holders from time to time.

    4.4. Any Match tickets purchased, or used in relation to, any Membership, shall be used subject to the Conditions of Entry from time to time and nothing in these Terms and Conditions shall operate so as to supersede or take precedence over such Conditions of Entry. Any Match tickets for matches not at the Ground will be subject to conditions of entry issued from time to time for that other ground.

    4.5. Nothing in these Terms and Conditions shall constitute or imply that you have a guarantee of entitlement to any ticket, seat or access to any area of the Ground or any other ground for any Match.

    4.6. The Member shall be entitled to the other benefits listed in Part II of these Terms and Conditions according to the type of Membership purchased.

    4.7. The benefits of Membership are as advertised by the Club fin promotional material or on the Website from time to time. The Club reserves the right from time to time to substitute replacement products or benefits as part of Membership in place of any products or services or benefits advised in promotional material or on the Website.


    5. Consumer Rights- Legal Right to Cancel Membership

    5.1. If the Purchaser is a consumer, they have a right to cancel their initial purchase within 14 days after the day on which they receive the confirmation of purchase. So if during this time a Purchaser changes his/her mind, he/she can notify the Club of their decision to cancel the purchase by contacting the Club's Box Office and receive a refund (the Club will refund on the credit card or debit card used by the Purchaser to pay, if applicable). If the Membership Card and welcome pack has been delivered to the Purchaser and/or Member before the decision to cancel the purchase, then they must return it to the Club without undue delay and in any event not later than 14 days after the day on which the Club has been informed of the wish to cancel the Membership.


    6. Dispatch of Membership Cards and welcome packs/gifts

    6.1 . All registered Members shall be issued with a Membership Card for their Membership Term. No action is required to activate Membership Cards.

    6.2 . Any Home Match Tickets purchased by a Member will automatically be uploaded onto the Membership Card, which should then be used to gain entry to the Ground for the relevant Match. Consequently, Members will not be issued with paper tickets for Matches unless notified otherwise by the Club, giving reasonable advance notice to the extent it is practical to do so.

    6.3 . The Club shall not have any liability to any Purchaser or Member for any non-delivery or late delivery of any Membership Card, ticket, documents or other materials dispatched by the Club to the Purchaser and/or Member resulting from the actions, omissions, malfunctions or interruptions of any postal services or incomplete or inaccurate personal details or Addresses provided to the Club.

    6.4 . All Membership Cards will remain the property of the Club at all times and may be confiscated, cancelled or withdrawn by the Club in accordance with these Terms and Conditions. Membership Cards must be produced along with evidence of identity if required by any official, steward or employee of the Club or any police officer.


    7. Lost, stolen and damaged Membership Cards and tickets

    7.1 . The Club is not responsible for any Membership Card or ticket which is lost, stolen, forgotten, damaged, defaced, or destroyed. One duplicate of any such Membership Card or ticket may be provided to the Member at the Club's absolute discretion subject to payment of a non-refundable administration fee of up to £10.00 to be paid by the Purchaser or Member prior to the issue of each duplicate Membership Card and/or ticket. Whether a Membership Card or ticket is damaged, defaced or destroyed will be determined by the Club acting reasonably in its sole discretion.


    8. Transfer of Membership and Cessation of Rights

    8.1 . In circumstances where a Purchaser purchases a Membership on behalf of another person:

    a. such purchase must not be made in the course of business or for the purpose of facilitating any third party's business;

    b. the Purchaser shall not charge the Member a fee for the purchase, or if a fee is charged, it must be for no greater in value than the face value of the Membership; and

    c. such nominated Member must be a supporter of the Club.

    8.2 . The Member on whose behalf the Membership is purchased pursuant to condition 8.1 shall adhere to and be bound by these Terms and Conditions and it is the responsibility of the Purchaser to inform such a transferee Member of these requirements.

    8.3. Memberships and Membership Benefits (including, without limitation, Membership Cards) are for the use of the Member only and are not transferable, except where expressly permitted by the Club in its absolute discretion. Membership Card transfers must not be made in the course of business or for the purpose of facilitating any third party's business.

    8.4. Members who purchase Match tickets using their Membership may from time to time be invited by the Club to purchase Match tickets for a guest who does not require a Membership in order to attend a Match ("Guest"). The Guest shall adhere to these Terms and Conditions which shall bind the Guest as if they were the original Member and/or Purchaser of that Membership. It is the responsibility of the Member who owns the Membership Card to procure that the Guest has read, and accepts that they shall be subject to, these Terms and Conditions.

    8.5 . Subject to conditions 8.1 and 8.3 above, all rights with respect to a Membership are personal to the Member and shall cease upon the death of the Member. Any Membership Benefits accrued including (without limitation) any Loyalty Points are not transferrable to any other person or organisation.


    9. Amendments to Memberships

    9.1 . The Club reserves the right to re-brand or otherwise vary any of the Memberships, or introduce any additional Memberships, at any time provided that any such variation shall result in a Member receiving the same or substantially similar benefits to those the Member was entitled to receive prior to such variation. Members may, at the sole discretion of the Club, be transferred to such additional or replacement Memberships without prior notice provided always that the Member shall be entitled to the same or substantially similar benefits under the new Memberships as the Member was under the Membership from which the Member was transferred.


    10. Suspension/Termination of the Membership by the Club

    10.1 Without prejudice to any other rights or remedies that the Club may have, the Club reserves the right to:

    a. suspend the use of a Membership and/or all or some of its associated benefits for a period of time;

    b. withdraw the use of a Membership and/or all of its associated benefits completely;

    c. terminate the Membership;

    d. prevent a Member and/or any individual in possession of a Membership Card (either indefinitely or for a period of time) from attending any future Home Match;

    e. bar a Member from any future application process conducted in respect of Match tickets; and/or

    f. provide the police or other relevant authorities with any relevant information,

    in any of the following circumstances:

    i. the Member breaches these Terms and Conditions, or otherwise misuses the Membership or Membership Card;

    ii. The Member breaches any of the terms and conditions of any other Club related scheme in which he/she is participating;

    iii. the Member acts, in the Club's opinion, in a manner inconsistent with the applicable laws, statutes or ordinances or if there are reasonable grounds for suspecting fraud, theft, or dishonesty in connection with the Membership;

    iv. the Member is guilty (or the Club suspects the Member is guilty) of a football related criminal offence;

    v. the Club reasonably believes an unauthorised person is attempting to access the Membership using a Member's account; or

    vi. any monies are due from a Member to the Club (whether in respect of their Membership or otherwise).

    10.2 . All Loyalty Points acquired by a Member may be revoked if that Member's Membership is cancelled, suspended or withdrawn in accordance with these Terms and Conditions, or if the Member is refused admission or banned from the Ground or any other sporting venue anywhere in the world.

    10.3 Except where a Member exercises their legal right to cancel under condition 5 above, if a Membership is cancelled by a Member, no refund will be paid to the relevant Member for any remaining period of Membership.

    10.4 The Club shall not be obliged to make any refund to a Member if that Membership and/or associated benefits are suspended or withdrawn or if their Membership is terminated by the Club pursuant to condition 10.1 above.


    11. Exclusion of Liability

    11.1 . The Club will not be liable to any Member for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:

    a. any failure or delay by the Club in carrying out any of its obligations under these Terms and Conditions which is caused by circumstances outside of the Club's reasonable control;

    b. any information provided to the Club by a third party; and/or

    c. any failure by a Purchaser/Member to provide updated contact/payment details in accordance with condition 13.

    11.2 . The Club shall have no liability whatsoever for any indirect or consequential loss or damage, loss of profits, loss of business, loss of business opportunity, loss of enjoyment or travel/accommodation costs.

    11.3 . To the extent permitted by law, the Club excludes all conditions, warranties, representations or other terms which may apply to the Membership, whether express or implied.

    11.4 . The Club assumes no responsibility for the services provided by any third party in connection with Membership competitions or benefits, including but not limited to the delivery, standard, quality or otherwise of any benefits provided by third parties or the failure of such a third party. Any issues relating to the purchase, delivery and return of a Membership Benefit should be addressed to the third party.

    11.5 . For the avoidance of doubt, nothing in these Terms and Conditions shall exclude or limit the Club's liability for death or personal injury caused by the Club or the Club's employees? negligence during the course of their employment; or any other conduct for which liability may not be excluded or limited as a matter of English law.


    12. Attendance at Matches and Entry into the Ground

    12.1 . In the event that a Member forgets their Membership Card in respect of any individual Home Match, such Member is advised to come to the Box Office with proof of identification and, subject to successful completion of security checks, the Club shall issue a paper ticket for that Home Match.

    12.2. The Club will not be obliged to make any refund to any Purchaser or Member in respect of any ejection from or refusal of entry to the Ground or in respect of any Membership Card which is suspended or withdrawn in accordance with condition 10.


    13. Change of Details

    13.1. Members should promptly notify the Club of any change of details (including, without limitation, changes to payment details Addresses and / or contact details) by:

    a. using the online facility on the Website;

    b. telephoning the Club and asking for 'Box Office';

    c. visiting the Club ticket office in person; or

    d. writing to the Club, for the attention of 'CPFC Box Office', quoting the relevant membership number.

    13.2 . Members may be required to provide the Club with proof of identity and Address to the Club's satisfaction when details are changed under this condition 13.1.


    14. Ticket Touting

    14.1. The unauthorised sale or disposal of a Ticket / Entry Materials may amount to a criminal offence under section 166 of the Criminal Justice and Public Order Act 1994, as amended by the Violent Crime Reduction Act 2006. This includes, but is not limited to:

    a. offering to sell a Match ticket (including, without limitation, via any website or online auction site);

    b. exposing a Match ticket for sale;

    c. making a Match ticket available for sale by another person;

    d. advertising that a Match ticket is available for purchase, which for the avoidance of doubt (and by way of example only) means that a Match ticket may not be offered as a prize in any promotion or competition;

    e. transferring, lending or selling a Match ticket to any third party as part of a hospitality or travel package; and/or

    f. giving (or offering to give) a Match ticket to a person who pays or agrees to pay for some other goods or services in return (or offers to do so),

    The Club will inform the police as soon as it becomes aware that Match tickets are being or have been sold in contravention of this law.

    14.2 . If a Purchaser, Member or Guest is convicted of a ticket touting offence anywhere in the world, or the Club reasonably suspects that a Purchaser, Member or Guest has committed a ticket touting offence anywhere in the world, the Club may notify the Premier League or Football League (as applicable) who in turn may notify other Premier League or Football League (as applicable) clubs and/or the relevant law enforcement authorities. The information that the Club shares may include personal details, information about the offence and about ticket purchases (including payment details). The Club will use this to identify and prevent ticket touting offences and disorder at Matches.


    15. Data Protection - How we may use a Purchaser's and Member's Personal Information

    15.1. Each Purchaser and Member acknowledges and agrees that the personal data provided by them to the Club in the purchase of a Membership or ticket shall be collected, stored and used by the Club in accordance with the Data Protection Act 1998 and the Club's Privacy Policy (available on the Website) and includes but is not limited to the Club using the personal data provided to give the Member marketing information, updates, promotions, offers about the Club's products or services that the Club and/or its business partners provide, but the Member may stop receiving these at any time by contacting the Club.

    15.2 . All persons who enter the Ground using a Membership Card acknowledge that photographic images and/or video recordings (and/or still taken from video recordings) may be taken of them to assist in the prevention or investigation of crime and in broadcasted televised coverage of Matches and/or for promotional or marketing purposes by the Club, the Premier League or the Football League (as applicable) or other third parties, and use of a Membership Card to enter the Ground constitutes consent to such use.


    16. Entire Agreement

    16.1. These Terms and Conditions together with the documents referred to herein, comprise the entire agreement between the Club and the Purchaser/Member in relation to the purchase of a Membership and all ancillary benefits.


    17. Severability and Amendments

    17.1 . The Club reserves the right to change these Terms and Conditions from time to time to reflect changes in relevant laws and regulatory requirements, and shall publicise such changes on its Website. Further the Club reserves the right to make other amendments to these Terms and Conditions from time to time, provided that, if the amendments are introduced during the Membership Term, the amendments shall not result in any Member receiving any less than the same or substantially similar benefits to those that the Member was entitled to receive prior to such amendments in relation to that Membership Term. Up to date versions of the Terms and Conditions will be made available promptly on the Website, and hard copies will be available from the Club upon request.

    17.2 . In the event that any condition(s) of these Terms and Conditions is/are declared void, ineffective or unenforceable by any competent court, the remainder of the Terms and Conditions shall remain in effect as if such void, ineffective or unenforceable condition(s) had not been included.


    18. Waiver

    18.1 . The Club's failure to exercise, or delay in exercising, any right, power or remedy provided by these Terms and Conditions or by law shall not constitute a waiver of that right, power or remedy.


    19. Third Parties

    19.1. Notwithstanding any other provision in these Terms and Conditions and with the exception of any football authorities, no other person other than the Member has any rights under the Contracts (Rights of Third Parties) Act 1999 to rely on or enforce any term of these Terms and Conditions. Nothing in these Terms and Conditions shall affect any right or remedy of a third party that exists or is available other than as a result of the aforementioned Act.


    20. Governing Law

    These Terms and Conditions shall be governed by and interpreted in accordance with the laws of England and Wales and are subject to the exclusive jurisdiction of the courts of England and Wales.


    Part II: Membership Benefits


    21. Membership Benefits

    During the Membership Term:

    21.1. Gold Members shall be entitled to the following benefits:

    a. 200 Loyalty Points upon purchase of Membership, subject to the terms and conditions of the Loyalty Point scheme from time to time;

    b. A Gold Members welcome pack (the contents of which are as published on the Website and communicated prior to purchase);

    c. A 10% discount applied in the Club shop (in person and online), when the Gold Member Client Reference I.D number is presented in person, or the Member is logged into their personal account when making a purchase online. This discount is valid on full-priced items only and cannot be used in conjunction with any other offer (unless the Club expressly states otherwise on specific offers).

    d. Eligibility to receive all Premier League Home Match or Football League Home Match (as applicable) programmes as a free downloadable match programme, sent via email with a link to view the programme online up to 24 hours prior to published kick off. The Member can also download the Club programme app to store downloads on the Member's smartphone or tablet.

    e. From time to time, Members may receive promotional offers ("Special Offers") for discounts to selected concession stands and team stores within the Ground or from commercial partners of the Club. The availability and frequency of any Special Offers are at the Club's sole discretion. Participation in the Membership does not guarantee access to Special Offers. A Member may be required to show their Membership Card or insert their Membership number at the point of sale to redeem any Special Offers. Special Offers must be valid at the time of redemption. Special Offers are non-transferable and not redeemable for cash. Special Offers expire and will be made available for specific time periods stated.

    21.2 . International Members shall be entitled to the following benefits:

    a. An International Members welcome gift, (the contents of which are as published on the Website and communicated prior to purchase);

    b. £10 credit applied to the International Member's account, online only. To redeem the £10 credit, the Client Reference I.D must be entered into the 'Got a promotion code' box on the Club Shop online basket page;

    c. 100 Loyalty Points subject to the terms and conditions of the Loyalty Point scheme from time to time;

    d. Eligibility to receive all Premier League Home Match or Football League Home Match (as applicable) programmes as a free downloadable match programme, sent via email with a link to view the programme online up to 24 hours prior to published kick off. The International Member may also download the Club programme app to store downloads on the Member's smartphone or tablet;

    e. From time to time, Members may receive promotional offers ("Special Offers") for discounts to selected concession stands and team stores within the Ground or from commercial partners of the Club. The availability and frequency of any Special Offers are at the Club's sole discretion. Participation in the Membership does not guarantee access to Special Offers. A Member may be required to show their Membership Card or insert their Membership number at the point of sale to redeem any Special Offers. Special Offers must be valid at the time of redemption. Special Offers are non-transferable and not redeemable for cash. Special Offers expire and will be made available for specific time periods stated;

    f. A 10% discount on a 1-night Exclusive Room stay at the Croydon Park Hotel, 7 Altyre Rd, Croydon, Greater London CR9 5AA. To redeem the 10% International Member discount the International Member must email reservations@croydonparkhotel.com including their full name, contact telephone number, International Member Client Reference I.D number, date of stay, length of stay to enquire about availability. The discount is subject to availability at the Croydon Park Hotel, and is only available on dates when the Club have Premier League Home Matches or Football League Home Matches (as applicable) on the specific day.

    21.3. Junior Members shall be entitled to the following benefits:

    a. A Junior Members welcome pack (the contents of which are as publicised on the Website and communicated prior to purchase).

    b. Invited to attend exclusive Junior Member events throughout the season, including but not limited to: Two player meet & greet events, a Junior Member Christmas party and an "End of Season party". All events are subject to availability and Junior Membership does not give Members guaranteed access to any event through the Season. All events will be advertised via CPFC Twitter, Facebook and Website, and also via email to the email as registered on the Junior Member account. The Club advises all Junior Members to ensure their email address is up to date in order to receive invites to these events. Please be aware that some events may incur a small additional charge of up to £10 per Junior Member.

    c. Invited to take part in free training events with the CPFC Football Foundation during the Season. All training events are subject to availability and Junior Membership does not give Members guaranteed access to any training events through the Season. These training events may be split into age groups due to CPFC foundation regulations. All training events will be advertised via CPFC Twitter, Facebook and website, and also via email to the email as registered on the Junior Member account. The Club advises all Junior Members to ensure their email address is up to date in order to receive invites to these events. The Club cannot guarantee when, where and how many training events will take place during the Season.

    d. Eligibility to receive all Premier League Home Match or Football League Home Match (as applicable) programmes as a free downloadable match programme, via email. The Club will send the Junior Member a link to view the programme online up to 24 hours prior to kick off. The Junior Member can also download the CPFC programme app to store downloads on their smartphone or tablet.

    e. 150 Loyalty Points subject to the terms and conditions of the Loyalty Point scheme from time to time.

    f. A 10% discount applied in the Club shop (in person and online), when the Junior Member Client Reference I.D number is presented in person, or the Member is logged into their personal account when making a purchase online. This discount is valid on full-priced items only and cannot be used in conjunction with any other offer (unless the Club expressly states otherwise on specific offers).

    21.4. Junior Members PLUS shall be entitled to the same benefits as the standard Junior Membership set out in Condition 21.3 above, with the additional benefit of receipt of a replica Club home shirt. The Junior Membership PLUS is strictly limited in availability.

    21.5. Silver Members shall be entitled to the following benefit:

    a . A Silver Members welcome gift (the contents of which shall be as published on the Website and communicated prior to purchase).
